GeneralBy commissioning the artist, you as the client agree that you have read and accepted this terms of service in full.Any necessary communication between the artist and client is expected. I will reply as promptly as possible, though delays may occur. I will inform the client of any unusual delays/circumstances.Reference images of your character(s) are preferred but not required. However, commissions done without a visual reference (based on only text description) will require an extra fee, as this counts as creating a new character design.If you would like a highly specific result for your commission, please be detailed in your description. (For example: Pose, facial expression, lighting, and the overall feeling the image should convey.) If you care less about the specifics, you may leave as many things as you would like up to my artistic freedom. If you leave any details unspecified, I will assume that you are purposefully leaving those details up to my choice.Artist reserves the right to terminate client interaction at any time and for any reason. Some cancellations may result in refund/partial refund to the client.Artist reserves the right to decline any commission, without need for explanation.Rights & PermissionsIn commissioning Drakovyte (hereafter known as the artist), you (hereafter known as client) are purchasing my labor only. The artist will retain full rights to all images. unless otherwise agreed upon.In commissioning the artist, the client agrees that the artist has permission to draw their character(s) and/or intellectual properties under your direction, but not in any commercial capacity unless agreed upon. The client agrees that if they are commissioning the artist to draw original characters that do not belong to them, that they have gotten permission from the character’s owners for them to be drawn by the artist, and that the content of the commission is known and approved of by them.The artist does not claim ownership of any intellectual property (characters, etc) depicted in work done unless otherwise stated. (For example: Intellectual property created by the artist and requested by the client). The artist may showcase art produced online and elsewhere. The artist may use images in portfolios, as commission examples, and in any other form of self-promotion. The artist will not sell prints or any other merchandise of individual pieces containing or depicting original characters without client’s permission.If a client wishes to remain anonymous, their name can be omitted from postings online.On request, client is able to receive a raw file containing the layers of the work. However, client is not authorized to make changes to those files and post them (i.e. recoloring to other characters) without the artist’s permission.Client may not claim work done by the artist as their own or use it for any external commercial project. Non-commercial projects (for example, making prints of commissioned art but not-for-profit) must be discussed with the artist beforehand to confirm no profit will come from the artist's work.Communication & PaymentPayment is required before any work begins. Payment through PayPal invoices is preferred, though if you are unable to use PayPal, ask me about alternative payment methods. Any quote for $100 or under requires full payment before starting, any quote for over $100 requires a 50% deposit before the artist begins working on the sketch. The artist will not continue any work past the completed sketch until the remaining 50% is paid.The client will be sent a WIP once the sketch is complete. At this time, the client may request for corrections to be made. Small changes are free, the first large edit is free. After the first large edit, editing fees will be applied. Any changes, small or large, past the sketching stage require editing fees.Errors that are the artist's mistake (were present in your references and I missed them etc.) can be fixed free of charge even after commission has been completed. Ex: wrong eye color, forgot to add an item of apparel, etc.WIPs can be provided at any point in the process upon the client’s request. Artist does not typically send more than the sketch WIP before completion unless requested.When finished, the artist will send the final artwork.Artwork will not be completed on a specific deadline unless agreed upon by the artist and client prior to payment. The client can generally expect to receive the sketch WIP 1-4 weeks after order placement. If the artist is unable to complete the commission for any reason, the client will be given a refund minus payment for work completed (percentage will be based on artist’s discretion) If the artist is unable to start the commission, a full refund will be given.Excessive harassment, rudeness, or abuse will result in a cancellation of the commission with a refund minus payment for work completed (percentage will be based on artist's discretion) and client will also be blacklisted from any further commissions.Anyone contacting the artist with an account that was made very recently or has no post history is excluded from commissioning the artist, as a preventative measure against block evasion.Subject MatterI specialize in drawing anthro characters and MLP-styled ponies, though I will also draw humans, creatures/monsters and animals/ferals. I will draw objects and backgrounds. Anything involving complex machinery or architecture will either be rejected or require an extra fee depending on specifics.ToS are subject to change without notice.
